Terms of Service

These Terms of Service (“Terms”) govern your use of NestTrack, a real estate productivity platform operated by Thomas Garuccio LLC (“NestTrack,” “we,” “us”). By creating an account or using the platform, you agree to these Terms. If you don’t agree, please don’t use the service.

1. Who can use NestTrack

You must be at least 18 years old and able to form a binding contract to use NestTrack. If you use NestTrack on behalf of a team or business, you represent that you have authority to bind that organization to these Terms.

2. Your account

You are responsible for keeping your login credentials secure and for all activity under your account. Notify us promptly at hi@nesttrack.io if you suspect unauthorized use.

3. Your data and your clients’ data

You retain ownership of the information you enter into NestTrack, including information about your clients and contacts. You are responsible for that information and for having the right to store and process it through our platform. You agree to use client information lawfully and in line with applicable privacy laws and any agreements you have with your clients.

Our handling of information is described in our Privacy Policy.

4. Acceptable use

You agree not to:

Use NestTrack for any unlawful purpose or to send spam or unsolicited messages in violation of applicable law (including the TCPA and CAN-SPAM Act);
Upload content that is illegal, infringing, or harmful;
Attempt to disrupt, reverse-engineer, or gain unauthorized access to the platform;
Resell or sublicense the platform without our written permission.

You are solely responsible for the messages, emails, and texts you send through NestTrack to your contacts, and for complying with all laws governing those communications.

5. Subscriptions and billing

Paid plans are billed on a recurring basis (for example, monthly per seat) through our payment processor, Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. Fees are described at the time of purchase. Unless required by law, payments are non-refundable. We may change pricing with reasonable notice; changes apply to future billing periods.

You can cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

6. Free trials and promotional offers

We may offer free trials or promotional pricing. Unless stated otherwise, when a free trial ends, your subscription will continue at the standard rate unless you cancel before the trial expires.

7. Service availability

We work to keep NestTrack available and reliable, but we provide the service “as is” and do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features from time to time.

8. Third-party services

NestTrack integrates with third-party services (such as Stripe, Google Firebase, OneSignal, Resend, and others you may connect). Your use of those services is governed by their own terms, and we are not responsible for them.

9. Disclaimers

NestTrack is a productivity tool. It is not a multiple listing service, a brokerage, a law firm, or a provider of legal, financial, or compliance advice. You are responsible for your own professional and legal obligations. To the fullest extent permitted by law, we disclaim all warranties not expressly stated in these Terms.

10. Limitation of liability

To the fullest extent permitted by law, NestTrack and Thomas Garuccio LLC will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits or data, arising from your use of the platform. Our total liability for any claim relating to the service will not exceed the amount you paid us in the twelve months before the claim.

11. Termination

You may stop using NestTrack and cancel your account at any time. We may suspend or terminate your access if you violate these Terms or use the platform in a way that risks harm to others or to the service. Provisions that by their nature should survive termination will survive.

12. Governing law

These Terms are governed by the laws of the State of Ohio, USA, without regard to its conflict-of-laws rules. Any disputes will be handled in the state or federal courts located in Ohio.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Continued use of NestTrack after changes take effect means you accept the updated Terms.
